1) EUROPEAN UNION–COMMUNITY TRADEMARK (CTM)
The CTM system consists of one registration procedure, one application at the OHIM, which grants the owner the exclusive right to use that mark in all the 27 member States of the EU. No other person can use the trademark in the whole European Union without the owner’s consent.
A CTM has a unitary nature, as with one application we have a mark valid in all the EU Member states.
2) WIPO/ MADRID PROTOCOL AND AGREEMENT(MADRID SYSTEM)
The Madrid system is an essential instrument in trade mark protection around the world; it is administered by WIPO, the World Intellectually Property Organization.
To make an application to the WIPO under the Madrid system for an international registration, we need to have a trademark already registered in a national country’s office, a country which is a member to the Madrid protocol.
We cannot apply directly to the WIPO for an international trademark registration; we need first a trademark registered in a national office which will be the basis of our international application.
The international application is made through the national trademark office.
